1. ACCEPTING THESE TERMS
This document, our rules, policies and the other documents referenced make up our Terms of Service (“Terms”). The Terms are a legally binding contract between you and us. This contract sets out your rights and responsibilities when you use IzzieProp. Please read them carefully.
BY USING OUR SITE, YOU’RE CREATING A LEGALLY BINDING CONTRACT TO COMPLY WITH ALL THE TERMS.
2. CHANGES
We may amend the Terms at any time by posting a revised version on IzzieProp. The revised version will be effective at the time we post it. If we change the Terms in a way that reduces your rights or increases your responsibilities, we will provide you with a notification.
3. ACCESS
You are granted a non-exclusive, limited and revocable license to access IzzieProp and use its functionality on the condition that:
(a) You are over the age of 18;
(b) You only use IzzieProp for lawful purposes;
(c) You do not engage in any improper, indecent or offensive behavior while using IzzieProp.
(d) You are not breaking any law in your relevant jurisdiction by accessing IzzieProp.
4. PRODUCT INFORMATION
We have made every effort to display as accurately as possible the colors of our products that appear on IzzieProp. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will accurately reflect the color of the product on delivery. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on IzzieProp are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions

5. YOUR DETAILS AND VISITS TO THIS IZZIEPROP

The information or personal details that you provide us shall be processed in accordance with the Privacy Policy. When you use IzzieProp, you agree to the processing of the information and details and you state that all information and details provided are true and correspond to reality.
6. AVAILABILITY OF PRODUCTS
All product orders are subject to availability. Along this line, if there are difficulties regarding the supply of products or there are no more items left in stock, we will reimburse any amount that you may have paid.
7. PRICE AND PAYMENT
The price of the products will be as stipulated at all times on IzzieProp, except in the case of an obvious error. Although we make every effort to ensure that the prices featured on IzzieProp are correct, error may occur. If we discover an error in the price of any of the products that you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and all amounts paid will be reimbursed to you in full. Prices may change at any time. However, except as stipulated above, the changes shall not affect the orders for which we have sent an Order Confirmation. Once you have selected all articles that you wish to buy, they will be added to your basket. The next step will be to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order. Payment can be made by Visa, Mastercard, American Express and PayPal. Credit cards are subject to verification and authorization by the card issuing entity. If the entity does not authorize the payment, we shall not be liable for any delay or failure to deliver and we will be unable to conclude any Contract with you.

8. REFUSAL TO PROCESS AN ORDER
We reserve the right to remove any product from IzzieProp at any time and to remove or modify any material or content from the same. Although we will always do everything possible to process all orders, there may be exceptional circumstances that force us to refuse to process an order after having sent the Order Confirmation. We reserve the right to do so at any time. We shall not be liable to you or to any third party for removing any product from IzzieProp, or for removing or modifying any material or content from IzzieProp or not processing an order once we have sent the Order Confirmation.

9. FORMALISING THE CONTRACT
To place an order, you must follow the online purchasing procedure and click on authorize payment. After doing so, you will receive an email confirming receipt of your order. These Conditions constitute a written contract between us and you. By accepting these Conditions, you confirm that you have had the opportunity to either accept or reject them, and to correct any errors in the Contract prior to entering into it. The Parties herein have agreed that the warranties implied by the applicable regulations (and as may be amended or replaced thereafter) are excluded, whenever possible and in accordance with the terms and conditions prescribed by law, and do not apply to this contract unless specifically stated otherwise.
10. PROHIBITED USES
You may not use, or encourage, promote, facilitate, instruct or induce others to use, IzzieProp or services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others; or to transmit, store, display, distribute or otherwise make available content that is illegal, fraudulent or harmful to others.
11. INTELLECTUAL PROPERTY RIGHTS
We retain all right, title, and interest in and to all Intellectual Property Rights related in and to IzzieProp and the services. Our logo and name are our registered trademarks. All other product names, company names, marks, logos, and symbols on IzzieProp or services may be the trademarks of their respective owners.
12. SECURITY
We ensure the protection and honesty of the data it gathers by utilizing fitting authoritative conventions, specialized shields, and actual security controls intended to restrict access, identify and forestall the unapproved access, inappropriate divulgence, adjustment, or obliteration of the data under its influence.

13. TERMINATION
We reserve the right to change, suspend, limit or discontinue any of its Services, in whole or in part at any time for any reason, without notice (unless required by law). We may refuse service to anyone and may terminate or suspend your services and your access to the IzzieProp in whole or in part at any time, for any reason, without notice unless required by law. If we terminate, limit or suspend your access to our IzzieProp. You don’t have a contractual or legal right to continue to use our IzzieProp.
14. LIMITATIONS
In no event will we be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, IzzieProp or any materials or content available through IzzieProp, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of damage. We shall not be responsible for any service interruptions, including, but not limited to, system failures or other interruptions that may affect purchases or sales, the receipt, processing, acceptance, completion or settlement of payment transactions, bank direct deposit transfers, or IzzieProp.

15. INDEMNIFICATION
You agree that you will be responsible for your use of IzzieProp, and you agree to defend and indemnify us from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: 

(i) your access to, use of, or alleged use of, the IzzieProp.

(ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation.

(iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right.

(iv) any dispute or issue between you and any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.

16. ENTIRE AGREEMENT
This Agreement contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof. The express terms hereof control and supersede any course of performance and/or usage of the trade inconsistent with any of the terms hereof.
